Appeals Court Freezes Ruling in Emirate Power Struggle

Kano – A dramatic turn in the ongoing Kano Emirate dispute has seen the Court of Appeal freeze its own earlier judgment. Its sitting in Abuja, halted the enforcement of its January 10 ruling, which had initially favoured the Kano State government’s repeal of the 2019 Emirates Council Law. The decision now rests with the Supreme Court, where an appeal is pending.

Stakes High in Legal Battle

Justice Okon Abang, leading a three-member panel, granted a stay of execution. This effectively pauses the legal battle and maintains the status quo. The move came after Alhaji Aminu Babba Dan Agundi (Sarkin Dawaki Babba) filed an injunction. He sought to prevent the Kano State Government from acting on the appellate court’s decision before the Supreme Court could weigh in.

Justice Abang emphasized the need for judicial fairness. The ruling orders all parties to maintain the situation as it existed before the Federal High Court’s June 13, 2024 judgment. He highlighted that Dan Agundi, having served as Emir for five years prior to his removal, possesses legal rights that warrant protection until a final verdict from the Supreme Court. This represents a significant, temporary victory for those challenging the Kano State Government.
