Lagos—Mudashiru Obasa, the former Speaker of the Lagos State House of Assembly, has filed a lawsuit challenging his recent removal. Obasa claims that his removal was unlawful because it occurred while the Assembly was on recess. He filed the suit at a state high court in Ikeja against the Assembly and the new Speaker, Mojisola Meranda.
Obasa’s legal team, led by Chief Afolabi Fashanu, SAN, filed a motion on February 12, 2025. The motion argues that the removal violated the constitution. It states the Assembly cannot sit during recess without the Speaker’s approval. Obasa is requesting a fast hearing of the case.
The lawsuit cites nine points, many based on sections of the 1999 Nigerian Constitution (as amended). Obasa wants the court to quickly schedule a hearing and shorten the time given for the defendants to reply.
The controversial Obasa removal has created discussion about whether the Assembly acted legally. Some say the removal was correct, citing claims of misconduct against Obasa. Others maintain that procedures were not followed.
The court has not yet set a hearing date. The final decision concerning the Obasa removal will have implications for the running of legislative work in Lagos State.
